BUSINESS MODEL
We are a for-profit entity and advise small business owners on loan packaging and optimizing their application process for business loans and grants. To qualify for our service guarantee, you must be responsive and commit to the additional management fee as described below.
American Capital Consulting uses experts to run our background reports check for grants and programs and provide recommendations. We are here to help you with your loan package to improve your chances for business funding. Once a payment or deposit is made and work is started the payment is non-refundable. Please respond to us within the required timeframe to ensure we have everything to complete your application.
To expedite your loan packaging process, we will complete your SBA and other loan and grant applications in a timely manner. You also agree to allow ACC to act as your proxy in getting background information and data to use in expediting and applying to business funding programs. sign off on all US SBA loan application certifications and agreements for disaster loans and grants as agreed.
CERTIFICATIONS
I certify my consent for American Capital Consulting (ACC) to represent me in my loan documentation and loan packaging for business funding.
Once the engagement between client and ACC starts, I hereby understand and authorize my payments in the amounts starting at $150 USD and various packages ranging through $2,500 USD plus 1.5% for filing my loan and/or grant applications as per SBA or other governing allow. I acknowledge responsibility for any additional collection fees that arise from my failure to pay the above-agreed amounts. For business expansion loans 7a, as per the “fee disclosure compensation agreement,” the payee is responsible for any contingency fee for loan funding and will be submitted to collections if the final payment is not settled within 30 days of client funding.
Payment terms
In consideration of Merchant accepting Customer’s payment, and other good and valuable consideration, Customer agrees that if any payment is returned unpaid for any reason, customer expressly authorizes Merchant or its processing agent or assignee to submit the case to collections. Fees for services and fees for collections will be charged to the client.
ACC notified me of my right to revoke this authorization in writing by contacting support@americancapitalconsulting within 48 hours or less of submitting the request or any other ongoing services before any other services are rendered. Refunds for work completed are non-refundable. I also understand ACC will keep an electronic record of my request. I may obtain a copy of this record by contacting ACC.
ACC is not liable for refunds (full or partial) for clients not meeting deadlines, requests for information, or documentation within a timely manner. ACC will remind clients via email, text, and/or phone to submit the requested information to move forward. Failure to provide ACC with requested information by reasonable deadlines will result in forfeit of the fee. A client that responds after the deadlines are not guaranteed services of any kind and can be reviewed on a case-by-case basis where additional fees might be incurred if it is responsible for ACC to reopen the case. Refunds are not granted for the following reasons:

Rates and fees are subject to change. ACC reserves the right to make these changes without notice.
Failure to process the payments in the fee schedule because of a lack of funds or insufficient funds will result in collections. Stop payment and NSF and collections fees will apply if payment is not made within 10 days. The failure to pay also creates a presumption for committing an offense, and this matter may be referred for criminal prosecution. We also have the right to proceed with reporting your debt to the credit reporting agencies where it could impact your credit rating and utilizing collection services to recoup lost funds.
Failure to make payment within 30 days after demand, the treble amount owed (three times the original amount), the amount owed, bank and court costs, reasonable attorneys’ fees (not less than $50 and no more than $2,500) will be applied to your total balance. If payment is made in 30 days, a service charge of $10 or 5% of the face amount of the check, whichever is greater, can be added. In stop payment action, reimbursement for actual travel expenses to the holder or agent for filing papers, and for traveling and providing witnesses to and from proceeding.
ACC headquarters are in Ft. Meyers, Florida. All questions concerning the construction, validity, and interpretation of this Agreement shall be governed by the law of the State of Florida. Any dispute arising out of, or concerning, this Agreement or the employment relationship between the parties, shall be resolved exclusively in a federal or state court of competent jurisdiction located in Florida. To the extent necessary, the parties hereby submit to and agree not to contest, the jurisdiction of such courts.
